Motion to dismiss Chauncey indictment denied
A published report says Scottsbluff County District Judge Leo Dobrovolny has ruled there is sufficient evidence to try the man accused of manslaughter and child abuse in the 2008 death of 2 year old Juliette Guerts of Gering.
The Star Herald reported this morning that Dobrovolny dismissed a motion by Dustin Chauncey's attorney to dismiss a grand jury indictment. Chauney was charged after a stalled investigation into the death led Juliette's aunt, Monica Hall to lead a petition drive resulting in the grand jury being convened.
The motion claimed the grand jury's finding of probable cause is not supported by the record, but Doborovlny found otherwise. Chauncey is currently scheduled to face trial during the August jury term.
