Bank robbery conviction to be appealed

A 44 year old Scottsbluff man sentenced to 20 years in prison for robbing the Scottsbluff Valley Bank location just before Thanksgiving last year has filed notice of his intent to appeal his conviction and sentence to the Nebraska Court of Appeals.

District Judge Randy Lippstreu gave Michael Scott the sentence September 30th. Scotts Bluff County Public Defender Bernie Streatker filed the appeal notice in District Court but a hearing will be held at a later date regarding Scott's legal representation. Straetker noted Scott wants to raise ineffective counsel in his direct appeal.

Scott also received a year in prison for his guilty plea to possession of methamphetamine in July. Lippstreu indicated when you add 314 days credit for time served in jail and a 12 to 18 month prison sentence for assaulting an inmate while in jail, Scott will be eligible for parole in 10 years and 6 months.
