Jury finds Little Eagle guilty in assault case
A 28 year old Scottsbluff man arrested in June for allegedly attacking a man with a baseball bat was found guilty of second degree assault by a Scotts Bluff County District Court jury Thursday.
Roy Little Eagle, who was already on parole after serving a prison sentence for burglary and theft, was charged with second degree assault, a class III felony.
According to court documents, the victim told police he was going to get money another man owed him when a car drove up in the alley and the driver got out of the car claiming the victim was saying bad things about his cousin before beginning to assault him with a bat. The documents say a witness told police the driver struck the victim in the head with the bat and hit him repeatedly after he fell to the ground.
Little Eagle was arrested after he was identified in photo lineup by both the victim and the witness.
The jury began deliberating around 1:30 Thursday afternoon and returned a verdict just after 5 p.m.
Little Eagle could receive up to 20 years in prison with the guilty verdict, and will be sentenced on November 22nd at 3:30 p.m.
