Bayard man charged with assaulting co-worker at sugar factory
A Bayard man has been taken into custody for assaulting a fellow Western Sugar employee with a hammer. 32 year old Jason Bates is charged with first degree assault in the disturbance that occurred on the second floor of the factory and was reported to the Scotts Bluff County Sheriff's office shortly before 9 p.m. Saturday evening.
Court documents indicate Bates is accused of striking Phillip McDaniel several times with a metal hammer. McDaniel claims he was struck because Bates found out he had been convicted of statutory rape. Bates told authorities he was acting in self defense after McDaniel hit him twice with a closed fist and came after him with the hammer. Bates claimed McDaniel had accused him of taking his phone the night before.
The arrest affidavit said McDaniel had a large laceration to his right eye that required hospital treatment. Deputy Robert Hackett said Bates did not have any defensive wounds.
Bates is being held on $35,000 bond with a 10% cash provision.
