Scott charges to be tried separately
Bank robbery suspect Michael Scott will face separate trials on two charges that were until now combined for one trial. In a motions hearing Wednesday, Public Defender Bernie Straetker argued that the bank robbery charge and the theft and fraud charges involving ATM cards should be tried separately.
County Attorney Doug Warner told the court that after reviewing the statutes, it appears the two cases should be handled separately. With no objection from the prosecution, District Judge Randy Lippstreu granted the motion to sever the cases.
Since pretrial was already scheduled for April 25th, the Judge requested the prosecution decide which case would move forward in the May jury term and inform the court by April 23rd ahead of the scheduled pretrial hearing.
The 42 year old is accused of robbing the Valley Bank and Trust branch at Broadway and Beltline in Scottsbluff just before Thanksgiving of last year. He is also accused of theft and fraud involving bank ATM cards. Scott will face a third trial involving the alleged assault of an inmate while being held in the Scotts Bluff County jail.
