Minatare man sentenced in child sex assault case
A 60 year old Minatare man was sentenced by Judge Randal Lippstreu Wednesday to serve 30 to 40 years in prison on a charge of attempted 1st degree sexual assault of a child.
David Nielsen was originally charged with four counts of possessing child pornography and one count of 1st degree sexual assault of a child. In a plea agreement with prosecutors, Nielsen agreed to enter a guilty or no contest plea to amended charges of attempted 1st degee sexual assault of a child, a class 2 felony. In exchange, the four counts of possession of child pornography were dismissed.
Court records show that a confidential informant told a Nebraska State patrol investigator that he had borrowed Nielson's cell phone to text when he observed a nude photo of the 16 year old girl in pictures on the suspect's phone. Further investigation indicated Nielsen had four nude images of the girl on his phone.
The court documents say Nielson told investigators he had been having sex with the girl, now 16, since she was 13 or 14 years old. Nielsen received credit for 97 days already served.
