Spitting speeder has 1st Court appearance

A 33 year old Scottsbluff woman stopped for speeding in Mitchell and arrested early Sunday morning on a number of charges after allegedly resisting arrest had a first appearance in Scotts Bluff County Court Monday.

Court documents say Elizabeth Arnold was pulled over just after midnight Sunday morning for speeding. Arnold told the Mitchell officer she did not have a drivers license, and stated she had a Colorado medical marijuana card and had 3.5 grams in her possession. A search of the vehicle located the marijuana, along with a hunting knife hidden under a rag between the drivers seat and the door.

The officer told her Arnold she would be released with just a citation, but after Arnold indicated she wanted to get out of Nebraska and never return, the officer feared she posed a flight risk and placed her under arrest. Arnold was handcuffed and placed in the back of the patrol car.

The documents say Arnold became angry and abusive, making threats and slipping out of her seatbelt. When the officer pulled over to attempt putting the seatbelt back on, Arnold refused to cooperate, threatening the officer. The officer warned Arnold to cooperate or she would be tasered. Arnold allegedly then spat at the officer, striking him in the eyes and mouth. The officer tasered Arnold in the back seat of the car, at which point she complied.

Arnold allegedly continued to spit at the officer from the back seat of the patrol car, telling the officer she was HIV positive, and he should get checked. The documents say Arnold continued to be combative at the jail, spitting on the officer three more times.

Arnold is charged with assault on an officer with bodily fluids, possession of marijuana, and speeding. Bond was set at $50,000 with a 10% cash provision. Arnold will have a preliminary hearing next Monday (4/21) at 3 p.m.
