Drug charge dismissed, informant arrested

A drug charge against a Scottsbluff man was dismissed during the middle of his trial Wednesday after the prosecution learned their main witness in the case had violated his confidential informant agreement. 42 year old Steve Magdaleno was accused in the case of selling methamphetamine to an informant working for the Wing Drug Task Force.

Scotts Bluff County Attorney Doug Warner says he learned early Wednesday that Brian Ross, the confidential informant in the case, had contacted someone in an effort to purchase methamphetamine for himself. After additional investigation, Warner decided he could not continue the case because of the actions by Ross. Warner said Ross was arrested Wednesday evening for possession of meth after taking possession of one gram of the illegal drug during a conntrolled buy set up between the person who contacted authorities and Ross. He was also arrested for wilful reckless driving, obstructing a law enforcement officer and second degree assault.

The 32 year old Ross was sentenced earlier this year to four years probation in a plea agreement regarding the sale of methamphetamine from the front counter of a local restaurant. At the time of sentencing, Warner praised Ross for his cooperation with authorities.
